Terms of service

Version 1.0 · Effective 25 October 2026

The agreement between you and Eye Candy Studio Private Limited for our content and social media plans, studio bookings and add-ons. We have tried to write it plainly.

The short version

  • Plans renew automatically until you cancel. Cancel anytime with no exit fee; your plan runs to the end of the paid period.
  • Every price shows the total with GST, and checkout shows the full breakup before you pay.
  • You own everything we make for you, raw footage included, from the day it is made.
  • Two rounds of changes on every piece. We don’t guarantee views, followers or sales.
  • Indian law applies. Disputes go to courts at Vadodara, Gujarat, and your consumer rights stay intact.

This summary helps you read the page; the numbered sections below are what apply.

1. Who we are

These terms are an agreement between you and Eye Candy Studio Private Limited (“Eye Candy”, “we”, “us”), a company registered in India under the Companies Act, 2013. “You” means the business or person who signs up for a plan or books our studio.

2. Accepting these terms

  • You accept these terms by ticking the box at checkout and paying. The box is never ticked for you. We email you a copy of the version you accepted, and we keep a record of when you accepted it.
  • You must be 18 or older and buying for your business or profession. If you sign up for a company, you confirm you are allowed to bind it.
  • Our refunds and cancellation policy and privacy policy are part of these terms.

3. Plans and what’s included

Each plan includes the monthly deliverables, platforms and features listed for it on our website at the time you sign up. Studio slots, ad management and other extras are optional add-ons: you choose them yourself, and we never add them for you.

On-location shoots outside our studio need extra crew and travel, so we quote them separately before any work starts. The Factory plan for larger brands is agreed with you in writing; where that agreement differs from these terms, the agreement applies.

4. Prices, GST and invoices

  • Prices are in Indian rupees and exclude GST at 18%. Every price on our website shows the total with GST beside it, and checkout shows the full breakup before you pay.
  • If your billing address or GSTIN is in Gujarat, we charge CGST and SGST; elsewhere in India, IGST. Please give us the correct business name, GSTIN and state, because that is what we put on your tax invoice.
  • We issue a GST tax invoice for every payment and a credit note for every refund.

5. Billing and automatic renewal

Plans renew automatically at the end of each billing period (monthly, quarterly or yearly) until you cancel. The renewal amount, GST included, and your renewal date are shown at checkout and in your portal.

  • You can pay by UPI AutoPay, card or eNACH bank mandate through our payment partner, Razorpay, or prepay for a quarter or a year. We never see or store your full card details.
  • Your bank may ask you to approve the first payment of a mandate. For renewals above the limit the Reserve Bank of India sets for automatic card and UPI debits (₹15,000 today), your bank may ask you to approve each renewal, so we may ask you to use an eNACH mandate or to prepay instead.
  • Your bank or UPI app tells you at least 24 hours before each automatic debit, and we also email you before each renewal. There is no fee for setting up a mandate; a small verification charge your bank takes when you set one up is refunded.
  • Plan upgrades and downgrades take effect from your next billing period. Payment mandates for UPI and eNACH can’t be changed mid-way, so a plan change may need a new mandate.

6. Failed payments

If a renewal fails, your bank or UPI app may retry it a few times. We will email you a payment link. If the payment is still not made 7 days after the due date, we pause work on your plan; after 30 days we may cancel it. Pausing or cancelling for non-payment doesn’t affect your ownership of work you have already paid for.

7. Cancelling, pausing and unused items

You can cancel anytime with no exit fee, pause for up to one month a quarter, and unused items carry over for one month. How each of these works, and when you get a refund, is set out in our refunds and cancellation policy.

8. Requests, changes and approvals

  • Two rounds of changes are included on every deliverable. A change is an edit within the brief you approved, such as a different hook, cut, caption or colour. A new idea or a new brief counts as a new deliverable.
  • Ask for changes within 7 days of delivery. If we hear nothing within 7 days, the deliverable is treated as approved.
  • Fixing our own mistakes never uses up a round.
  • We quote extra rounds before starting them. Rush delivery is charged at the add-on price on our website.

9. You own your work

Everything we make for you is yours from the day it is made: raw footage, photographs, final edits, scripts, captions, graphics and any original music we create for you.

  • Photographs and videos, raw and unused footage included, are made at your request and for payment, so you are their first owner under section 17(b) of the Copyright Act, 1957.
  • For everything else, we assign to you all copyright in each work as soon as it is created: worldwide, for the full term of copyright, in all media and formats, including short-form video, social media posts, paid advertising, websites, print, outdoor, broadcast and media not yet invented. Our fees include everything you owe for this; no royalty is payable. Section 19(4) of the Copyright Act does not apply, so the assignment doesn’t lapse if you don’t use a work.
  • At the start of your plan we send you a deed of assignment, digitally signed by us, confirming this. We will sign anything else reasonably needed to confirm your ownership.
  • The people who make your work (our team and freelancers) have agreed not to object to how you use or edit it.

10. Music, stock, fonts and our tools

Some things inside your content belong to others and are licensed, not owned. Their licence terms apply to you.

  • Music: tracks from Meta Sound Collection may be used only on Meta apps (Instagram and Facebook). If you want to post a reel elsewhere, such as YouTube, tell us and we will use a track licensed for that. Don’t add trending or commercial music from personal libraries to business posts.
  • Stock footage, images and fonts are covered by the licence we buy for your use in the content we make.
  • Our tools (presets, LUTs, templates, motion graphics we reuse across clients) stay ours. You may use them for ever as they appear in your deliverables.
  • AI-generated elements: where we use AI tools, you get whatever rights exist in what they produce. Indian law on ownership of AI output is still unsettled.

11. Showing your work in our portfolio

Once you have published a piece yourself, we may show it in our portfolio and on our own channels to show what we do. We never show unpublished work. If you would rather we didn’t show your work, email hello@theeyecandy.studio and we will stop and take down what we can.

12. Your social and ad accounts

  • Your social media pages, business profiles and ad accounts stay registered in your name, with your email and two-factor login. You give us access through each platform’s partner or team-member settings.
  • Where a platform has no such setting and we need a password, we ask for your written consent first, keep it encrypted and use it only for your work.
  • You can remove our access anytime. When your plan ends, we remove ourselves from your accounts and delete any stored logins.

13. Ad management

  • You pay your ad spend directly to the platform from your own ad account. Our fee covers planning, setting up and running campaigns; it never includes ad spend, and we don’t charge a percentage of it.
  • You approve each campaign’s budget and cap. We don’t spend beyond what you approve.
  • Under Indian advertising rules, both the advertiser and the agency must be able to back up the claims in an ad. You confirm the claims you give us are true, and you will share proof when asked.

14. Your materials and claims

  • You confirm you have the rights to everything you give us (logos, product photos, music, footage) and any licence your business needs to advertise what it sells.
  • You are responsible for consent and releases from your own staff and customers who appear in your content. Talent we bring is covered by our own releases.
  • If a claim is made against us because something you supplied, or a claim you asked us to make, breaks the law or someone’s rights, you cover our reasonable costs of dealing with it.

15. What we won’t make

We may refuse or stop work that is unlawful or harmful, without refunding work already done. That includes:

  • promoting online money games, betting or gambling;
  • surrogate advertising for alcohol or tobacco;
  • unregistered investment advice or guaranteed-return schemes;
  • health, medical or weight-loss claims that can’t be supported;
  • deepfakes, or cloning anyone’s face or voice without their written consent;
  • hateful, obscene, defamatory or misleading content.

16. No guaranteed results

We work hard to make content people stop for, but no one controls the platforms. We don’t guarantee any number of views, followers, leads or sales. We are not responsible for account suspensions, demonetisation, algorithm changes or loss of reach that we didn’t cause.

17. Confidentiality and AI tools

  • We keep your briefs, plans, launch dates and account information confidential and use them only for your work. If you share our pricing or methods marked confidential, please do the same.
  • We may use AI tools to help with editing, captions and ideas. We use only tools that don’t train on your material, a person reviews everything before it reaches you, and we don’t clone anyone’s face or voice without written consent.

18. Our liability

  • To the extent the law allows, our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim arose.
  • We are not liable for indirect losses, such as lost profits or lost opportunities, that don’t follow directly from what went wrong.
  • Nothing in these terms limits our liability for fraud, gross negligence, or deficient or not-as-described work, or any right you have under consumer protection law.

19. Things outside anyone’s control

Neither of us is responsible for delays caused by events beyond reasonable control, such as natural disasters, epidemics, government orders, internet shutdowns or platform outages. If we can’t deliver part of a month for one of these reasons, those items don’t expire: we deliver them later or refund their share. Platform algorithm changes are not such an event.

20. If we suspend or end your plan

We may suspend or end your plan if you seriously break these terms (for example, non-payment or asking for content we won’t make) and don’t put it right within 7 days of our email. We may also stop offering a plan by giving you 30 days’ notice. If we end your plan when you haven’t broken these terms, we refund the unused part of what you prepaid. After any plan ends, your files stay available to download for 90 days, and we email you before we delete them.

21. Changes to these terms or our prices

We will email you at least 30 days before any change to these terms or to your plan’s price, and show what changed. Changes apply from your next billing period after that. If you don’t agree, you can cancel before then without any charge. For significant changes we ask you to accept the new terms again. Earlier versions stay available on request.

22. Governing law and disputes

These terms are governed by the laws of India. We would always rather sort out a problem by talking first: please contact us, and our grievance officer if needed.

Subject to that, the courts at Vadodara, Gujarat have exclusive jurisdiction over any dispute. This doesn’t take away any right you have to approach a consumer commission under the Consumer Protection Act, 2019.

23. Complaints and grievance officer

You can raise any complaint with our grievance officer, Jimit Shah (Director). How to reach them, and how quickly we respond, is on the contact and grievances page.
